A deported illegal alien who is considered a “Dreamer” because of his age, is accusing immigration officers of forcing him into Mexico in the middle of the night, illegally deporting him without giving him legal council.

The Department of Homeland Security and US Customs and Border Protection deny his accusation, and say he remains in Mexico because his DACA status was revoked.

According to Juan Manuel Montes, he was visiting his girlfriend in Calexico, California on February 18.  After being stopped by immigration officers, he was unable to provide identification. Montes admittedly was not carrying his wallet, which contained his state identification card and federal work permit.

He says US Border Patrol agents took him to a local station, where he was asked to sign papers and wait for several hours.  He claims he was not provided legal counsel at the time. Eventually, he was delivered by car over the border to Mexicali, Mexico at approximately 1 am.

Montes later attempted to cross back into the U.S, but US Customs and Border Protection (CBP) agents caught him and deported him again.

Allegedly, the Department of Homeland Security (DHS) told Montes there were no records of him being deported the night of February 18, but the CPB had records of apprehending him when he attempted to cross back over the border. DHS says Montes’ DACA status was active, but it was revoked after he voluntarily crossed the border.

On behalf of Montes, The National Immigration Law Center (NILC) issued a press release Friday announcing that his attorneys had filed new declarations from witnesses that say the government’s account of the incident is wrong.

What happened to Juan is clear. He was unlawfully removed from his home and community, and should be returned home.

“Juan Manuel was ripped from his family and community in the dead of night without a chance to even say goodbye, collect his belongings, or find a safe place to stay,” said Nora A. Preciado.

Monica Almadani, an attorney representing Montes, said he was forced into Mexico. “As demonstrated by our filing today, Juan Manuel was unlawfully expelled from the United States, and the government must bring him back,”said Almadani.

Witnesses in multiple declarations filed Friday corroborate Montes’ assertion that immigration agents forced him across the border.

According to DHS, Montes could not have been deported at 1 a.m. An agreement between US and Mexico says immigrants can only be deported between 6:00am and 10:00pm.

Montes has been living with relatives in Mexico since his deportation.
